{"id":1208,"date":"2014-11-21T01:00:00","date_gmt":"2014-11-21T00:00:00","guid":{"rendered":"http:\/\/%20rroma.org\/21-11-2014-german-federal-supreme-court-asked-to-take-a-stance-on-its-hostile-judgments-on-rroma\/"},"modified":"2022-07-27T07:48:52","modified_gmt":"2022-07-27T06:48:52","slug":"21-11-2014-german-federal-supreme-court-asked-to-take-a-stance-on-its-hostile-judgments-on-rroma","status":"publish","type":"post","link":"https:\/\/rroma.org\/de\/21-11-2014-german-federal-supreme-court-asked-to-take-a-stance-on-its-hostile-judgments-on-rroma\/","title":{"rendered":"21.11.2014 German Federal Supreme Court asked to take a stance on its hostile judgments on Rroma"},"content":{"rendered":"<p style=\"text-align: justify;\" class=\"MsoNormal\">Romani Rose, chairman of \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tthe central council of German Sinti and Rroma, has demanded the German Federal \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tSupreme Court in a statement on the 4th Roseburg-symposium to take a stance on \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tits jurisdiction against Rroma under National Socialism and in the post-war \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tperiod. In 1956, the Federal Supreme Court (BGH) had largely rejected the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tclaims of Holocaust survivors for compensation, on the grounds that there had \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tbeen earlier official measures against Rroma: <em style=\"font-family: Arial;\">\u201cIn January of 1956, the Federal Supreme Court had largely denied \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tcompensation to \u201cgypsies\u201d who were persecuted by the Nazis. The exclusion and \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tresettlement policy of the Nazis until 1943 was denied to have been motivated \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tby their racial fanaticism, but was said to be part of the \u201cusual police \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tpreventive measures\u201d. The judges of the Federal Supreme Court justified their \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tverdict with the suggestion that due to the nature of the people, there had \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\talways been measures against the \u201cGypsy plague\u201d.<\/em> <em style=\"font-family: Arial;\">Without any relativization it says<\/em>: <em style=\"font-family: Arial;\">\u201cThey tend, as experience shows, towards crime, particularly thefts and \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tfrauds, they often lack the moral drives to respect the property of others, \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tbecause they appertain like primitive men an unrestrained occupation instinct.\u201d<\/em> It was not until 1963 that at the Federal Supreme Court recognised that Rroma \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\twere persecuted in Nazi Germany before 1943. However, the racist police \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tconsiderations, which allege a collective predisposition to crime for Rroma, were \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tstill recognised. Rose therefore demanded an official dissociation of the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tFederal Supreme Court from its past verdicts, as he stated at the symposium: <em style=\"font-family: Arial;\">\u201c\u201cThen, the Supreme Court adopted the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tjustification strategy of the Nazis and their demagogic agitation\u201d, criticized \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tRose. Until today, there has been no dissociation on part of the Federal \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tSupreme Court. \u201cWe would appreciate it very much if such a statement \u2013 in \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\twhatever form \u2013 would be possible today.\u201d\u201d<\/em> \u2013 In Auschwitz-Birkenau alone, \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t30,000 Rroma were murdered.
