The prosecution requested for five of the fifteen \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tdefendants the maximum sentence of ten years of imprisonment. The Rroma are \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\taccused of deliberately having instigated minors to steal and to having traded \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tthem amongst each other. The children were literally educated to steal, the prosecution \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tstates. The charge is organised crime, human trafficking and group theft. The \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\taccused are charged with the involvement in over a hundred thefts, of which the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tvast majority was committed in France. The gangs were allegedly built on \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\thierarchical families, that were lead by a clan chief: <em style=\"font-family: Arial;\">\u201cFor the judiciary, those offenders, who settled on sites in \u00a0Lorraine and Alsace, belong to family \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tstructures that are completely hierarchiszed, \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\twith up to seven clans operated in the mode of groups that are \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tdirected by family chiefs from afar. The operation mode was always the same: burglaries \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tduring a few days, aimed at homes in a given sector, virtually raids to find jewellery \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tand money\u201d<\/em> (Nicolas 2014). With this charge, Nicolas conveys a \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tcommon misconception about Rroma. The accusation of criminal, hierarchically \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\torganised family-gangs, who commit crimes on the command of a clan chief, has \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tbeen transformed into an unquestioned fact. However, this supposed fact is \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tbased on massive prejudices, misinformation and culturalising racism. Rroma are \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tnot more criminal than other ethnic groups. A cultural explanation for crime is \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tnecessarily racist and ignores and discredits the majority of the blameless \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tRroma, living integrated. The idea of hierarchical family ties traces back to \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tthe projection of the medieval caste system onto the Rroma. However, this is \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tincorrect. While it is true that the family has an important place among the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tRroma, the organization is largely egalitarian. In addition, the stereotype of \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tarranged marriages is communicated, which is only true for a minority of the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tRroma. Furthermore, the phenomenon of child trafficking, as it is presented here, \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\thas to be critically questioned. Social science studies show that social \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\trealities behind begging or petty crime are largely hidden. Similarly, the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tstructural differences of the societies involved and any related reasons for a \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tmigration from Romania to France.
