At the centre of interest lies the case of the Rrom Mario Gyula Varga. \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tWhile the mother and the half-brother of the man were able to present to the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tcourt convincingly that they were victims of domestic violence by the father of \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tVarga, a violent pimp, and were persecuted by neo-Nazi groups, the application \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tof Mario Varga himself was rejected as implausible. From the perspective of the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tjudge, the applicant could not demonstrate convincingly that he was indeed a \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tvictim of violence in Hungary. Instead, he had argued with the general \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tpersecution of the Rroma in Hungary. This general discrimination against Rroma \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tthe judge ruled improbable: <em style=\"font-family: Arial;\">\u201c\u201cIt seems to \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tme that [Mr. Varga\u2019s lawyer\u2019s] submission is that the only reasonable \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tassessment of country conditions in Hungary is that each and every one of its \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t200,000 to 500,000 citizens of Roma background has a well-founded fear of \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tpersecution for reasons of race, and that on the balance of probabilities, each \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tand every one\u2019s life is at personal risk, or that each and every one is at risk \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tof cruel and unusual treatment or punishment. If it be so, then Hungary is a \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tfailed state. Yet it is not\u201d, Justice Harrington wrote in his ruling last \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tweek.\u201d<\/em> The case shows that evidence for individual asylum applications is \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\textremely difficult to prove. Official governmental countries analyses are juxtaposed \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\twith subjective experiences, which usually are express only orally, but cannot \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tbe verified. Then, the credibility of the argument is an important criterion. \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tThe verdict is therefore also associated with the assessment of the conditions in \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\ta country and related value judgments. The estimation of compliance with the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\trights of minorities in Hungary is far from evident, as can be read in the \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tcritical, Hungarian press. Violations of minority rights and rights against \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tdiscrimination repeatedly occur. Therefore, the verdict of judge Harrington \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tthat Hungary is a failed state, if the arguments of the applicant are true, is not \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tthat far-fetched.<\/p>\n<ul>\n<li>Humphreys, Adrian (2014) Simply being Roma from \t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\tHungary is not proof of persecution, refugee judge rules.
