Romania: Several People Fired for Theft

Several leading civil servants, among which the head of the Tax authority, were fired in Romania for having stolen funds from the EU development aid. According to prosecutors “two Romanian lawmakers and eight other persons had allegedly defrauded two projects worth a total 27.25 million lei ($6.91 million) aimed at supporting the underprivileged Roma minority.”

And one wonders why nothing changes …

More work and more information is still required on this topic.

05.12.2014 Prosecutor of Paris: criminal court not competent to judge Manuel Valls

Libération (2014) reports on a recent decision of the Paris prosecutor. The investigation covers statements by Prime Minister Manuel Valls, in which he claimed that Rroma had the inclination to stay in Romania or to return there, and they had a very different lifestyle than the French, which was inevitably in confrontation with the French one. The Paris prosecutor’s office now judged on December the second that the criminal court was not competent to judge the statements made by Manuel Valls. The criminal chamber will pronounce its verdict in this regard on December the 19th. However, the plaintiff against Valls, the organisation “La Voix des Roms”, wants that his statements are not judged independently of his function as the then Interior Minister, but are recognised as demagoguery: “For the lawyer of Manuel Valls, Mr. Georges Holleaux, the statements of his client are adjacent to “his ministerial competence”. In his view, the facts thus reverse the Court of Justice of the Republic (CJR), the only institution empowered to judge members of the government, for deeds which they have committed in the function of their office. Moreover, he pointed out that that Mrap (Mouvement contre le racisme et pour l’amitié entre les peuples) had filed a lawsuit against Manuel Valls at the the Court of Justice of the Republic in September 2013, which was dropped it without further consequences.” Manuel Valls is not an isolated case with his racist remarks against the Rroma. In recent years, numerous French mayors and politicians have gained public attention with racist remarks about Rroma. Some were sentenced to mild fines, others were completely acquitted, referring to the freedom of expression. In the French public, Rroma are equated with 15,000 to 20,000 Rroma who live in illegal settlements. The 100,000 to 500,000 Rroma who are integrated in France since generations, are continuously ignored. The Rroma are also repeatedly exploited by various parties for political purposes and blamed for social ills that have their origins in society as a whole, and not in a single minority. Unfortunately, this scapegoat policy finds approval among a shocking number of people (compare L’Yonne Républicaine 2014).

21.11.2014 German Federal Supreme Court asked to take a stance on its hostile judgments on Rroma

Romani Rose, chairman of the central council of German Sinti and Rroma, has demanded the German Federal Supreme Court in a statement on the 4th Roseburg-symposium to take a stance on its jurisdiction against Rroma under National Socialism and in the post-war period. In 1956, the Federal Supreme Court (BGH) had largely rejected the claims of Holocaust survivors for compensation, on the grounds that there had been earlier official measures against Rroma: “In January of 1956, the Federal Supreme Court had largely denied compensation to “gypsies” who were persecuted by the Nazis. The exclusion and resettlement policy of the Nazis until 1943 was denied to have been motivated by their racial fanaticism, but was said to be part of the “usual police preventive measures”. The judges of the Federal Supreme Court justified their verdict with the suggestion that due to the nature of the people, there had always been measures against the “Gypsy plague”. Without any relativization it says: “They tend, as experience shows, towards crime, particularly thefts and frauds, they often lack the moral drives to respect the property of others, because they appertain like primitive men an unrestrained occupation instinct.” It was not until 1963 that at the Federal Supreme Court recognised that Rroma were persecuted in Nazi Germany before 1943. However, the racist police considerations, which allege a collective predisposition to crime for Rroma, were still recognised. Rose therefore demanded an official dissociation of the Federal Supreme Court from its past verdicts, as he stated at the symposium: ““Then, the Supreme Court adopted the justification strategy of the Nazis and their demagogic agitation”, criticized Rose. Until today, there has been no dissociation on part of the Federal Supreme Court. “We would appreciate it very much if such a statement – in whatever form – would be possible today.”” – In Auschwitz-Birkenau alone, 30,000 Rroma were murdered. Researchers estimate at least half a million casualties among the Rroma (Rath 2014).

19.11.2014 Stereotypes: criminal Rroma clans

Guggisberg (2014) reports on criminal Rroma clans that allegedly force children into crime. Parents surrender their children to an omnipotent clan chief – to whom they are indebted – for begging and theft and some even end up in prostitution. Guggisberg uncritically reproduces the perspective of the “Wiener Drehscheibe”, a social service for begging and stealing children who have been arrested by the police. Guggisberg does not question that the social educator Norbert Ceipek – the head of the institution – who identifies each begging or stealing child as a victim of human trafficking, could himself be subject to prejudices and be providing misinformation on Rroma: “Ceipek opens another photo file. It shows a Roma village in Romania, which he recently visited. He tells of houses, cobbled together from planks and plastic sheeting, and dirt roads full of garbage. In the middle is a magnificent villa.It belongs to the clan chief. He rules the villages as a state within a state”, says Ceipek […]. Many of the children dealt with in Vienna belong to the Roma. […] “The phenomenon of Eastern European gangs of beggars is not new. But since a couple of months, it taken new proportions”, says Ceipek. Very active are the Bosnian gangs, he states. Every few weeks, they would bring the children to different European cities, according to a rotating system. The social worker explains that his aim was to provide a perspective to the children, a little education. They might get on better path.”” Alexander Ott, head of the Foreign Police Bern, who has already been quoted repeatedly in articles about criminal Rroma gangs and trafficking of children, has his say. He reproduces the usual prejudices about hierarchical Rroma clans with a clan chief who leads children into crime: “The network of child traffickers reaches from Eastern Europe to Switzerland. “The victims are recruited in Romania, Bulgaria, Bosnia, Serbia, Kosovo, Macedonia, Czech Republic and Slovakia. Often they come from large Roma families, are purchased or borrowed”, says Ott. One sends the boys to steal, urges them into prostitution, or forces them to beg. The instigators know well that the Swiss justice system cannot prosecute the perpetrators because of their young age. Adolescent burglars are booming in the autumn and winter months. Ott emphasises that they have to deal with highly professional, specialised and hierarchically-run clans, who practice their craft since generations.” Rroma are not more criminal than other ethnic groups. They are not hierarchically organised, as is often claimed, but structured largely egalitarian. So-called “Rroma kings” are self-elected and have purely representative character. Guggisberg and experts’ claim that behind begging children there is inevitably trafficking and organized crime, is wrong.

The characteristics of transnational operating trafficker networks, as presented here, are questioned by social science research. Their existence itself is not denied, something that cannot be in the interest of combating injustice. But their manifestation, their number, their omnipotence and the motivations attributed to them have to be questioned. These are often tainted by ideological fallacies, brought into connection or even equated with ethnic groups such as Rroma. Furthermore, the equation of child migration and trafficking has to be set into context. The stereotype of Rroma as child traffickers dates back to their arrival in Western Europe, and is in part based on the racist notion that Rroma did actively recruit children for criminal gangs. Regarding the topic of child migration, social science studies convey a more complex notion on the subject and point out that crimes such as incitement to beg and steal or alleged child trafficking are often permeated by various morals in the analysis and assessment by authorities, who don’t appropriately consider the perspective and motivations of migrating children and their relatives, and instead force on them their own ideas and definitions on organised begging, criminal networks or child trafficking. Structural differences of the societies involved and resulting reasons for a migration are given too little consideration. In reality, behind begging children there are often simply impoverished families, in which the children contribute to the family income and who therefore do not correspond to bourgeois notions of a normal family and childhood. De facto child trafficking is rare according to the sociological studies. Furthermore, the incomes from begging are very modest, which makes them unattractive for organised crime.  Guggisberg, who states that 200’000 children are recruited annually by the trafficking mafia, contradicts this. 

At the end of the article, Guggisberg quotes another expert opinion by Norbert Ceipek, the director of the “Wiener Drehschreibe”: At 15, many of them would get married and have children themselves, so that the cycle of crime continues. Likewise, Guggisberg reproduces this racist prejudice uncritically. The majority of Rroma, who live integrated, go to work and send their children to school, remain unmentioned (compare Cree/Clapton/Smith 2012, O’Connell Davidson 2011, Oude Breuil 2008, Tabin et al 2012).

01.11.2014 Romani Rose condemns migration policy towards Rroma

In a recent statement, Romani Rose, chairman of the central council of German Sinti and Rroma, criticised the repressive migration and asylum policy towards Rroma from Eastern Europe. 25 years after the end of the Soviet bloc, a new wall between East and West Europe menaces to emerge, fuelled by xenophobic policies and corresponding migration measures, particularly aimed against Rroma: “25 years after the fall of the wall, Romani Rose, chairman of the central council of German Sinti and Roma, cautions against a new division of Europe – at least for the members of his minority. The debate about the so-called poverty migration, which took place on the back of the Roma, has led to the situation in Eastern Europe “that someone with dark eyes and dark hair is arrested on the border”, Rose said during a visit to the of Bundestag Vice-President Claudia Roth (Green) at Central Council in Heidelberg. […] For the Roma of the Balkans, Roth called for a rapid improvement in the situation. “We must begin by acknowledging that there is a group-specific persecution: these people are persecuted and discriminated against because they are Roma”, Roth said. About the last point, however, there is no consensus. While most experts agree that Rroma are affected by severe economic hardship and discrimination in everyday life, there is no consensus on an ethnic-related persecution. This is disputed by various parties, which refer to the long, historically documented integration of Rroma in Eastern Europe. Comprehensive, objective studies on the situation of Rroma since the end of the Soviet bloc, about the rise of nationalism and the Yugoslav wars, which massively altered the socio-political situation – and renewed and ethnic divisions – are rare. Rose also expressed the wish that a museum about the Rroma history should be opened in Berlin. The monument alone conveys too little background knowledge about the history of exclusion and persecution of the minority, he stated (Rhein-Neckar Zeitung 2014).

17.09.2014 Survey of antiziganism: prejudices against Rroma in Germany remain

Several German newspapers report on the latest study by the centre for anti-Semitism research in Berlin and the institute for prejudice and conflict research. For the study “Between apathy and rejection – Population attitudes towards Sinti and Roma” around 2,000 German citizens were interviewed. The study concludes that about a third of Germans feel Rroma as neighbours as being very or quite unpleasant. There is less sympathy towards Rroma than towards any other population group. Seventeen percent of the respondents consider them as very unappealing. This result is clearly linked to the opinion of the respondents that Rroma are responsible for the reservations towards their minority due to their own behaviour. This point is based on the false assumption that a visible minority of the minority can be equated with all Rroma. However, most Rroma are not delinquent and are integrated. This is ignored by the media and by the public. The following three results show how ingrained prejudices and resentments against the minority are: fifteen percent of the respondents consider Roma as criminals, fourteen percent as not assimilable, ten percent as lazy. Again, the prejudices are based on the public perception of a visible minority of the minority. The majority of the Rroma are integrated and are honest. The final result of the study is of particular concern: every second respondent thinks that a restriction of the entry requirements is an appropriate way to solve the problems with the minority. Again, there are misconceptions about a mass influx of poorly educated and delinquent Rroma. Rroma constitute only a part of all immigrants from South and Eastern Europe. Many of them are ethnic Romanians, Bulgarians, Macedonians, etc. There are also many well-educated Rroma, who are also hidden in the media. Romani Rose, president of the central council of German Sinti and Roma, raised severe concerns about the results of the study: “anti-Semitism is outlawed in Germany, antiziganism enjoys largely a free rein”, criticised Romani Rose […]. He warned against connecting poverty with ethic origin. “The Jews were too rich, the Roma are too poor.” This is an unacceptable generalisation” (Peters 2014). After all, Rose sees it as positive that around 80% of the respondents knew about the persecution of the Rroma during National Socialism. Nevertheless, knowledge about the minority needs to be deepened more through history lessons. This contrasts with the opinion of almost a third of the respondents who feel no historical responsibility of Germany towards the minority. One in five is for the removal of the Rroma from Germany: a very thought-provoking insight. In response to the poor results, an expert commission shall be set up to report to the Bundestag regularly on discrimination against the minority in the fields of education, employment or housing. The anti-discrimination commissioner of the state, Christine Lüders, also sees a special need for action in the fight against prejudice among police forces. Rroma in Germany are still more frequently suspected of criminal activities as members of other ethnic groups. She argues that “indifference, ignorance and rejection together form a fatal mix that [enable and foster] discrimination against Sinti and Roma” (compare Antidiskriminierungsstelle des Bundes 2014, Die Zeit 2014, Fürstenau 2014, Gajevic 2014, Gensing 2014, Lambeck 2014, MiGAZIN 2014, Süddeutsche Zeitung 2014).  

17.09.2014 Serbia, Macedonia and Bosnia-Herzegovina: safe countries of origin for Rroma?

The daily news of the ARD (2014) reports on the ongoing discussions and protests because of the declaration of Serbia, Macedonia, and Bosnia-Herzegovina as being “safe countries of origin”. Accordingly, the federal government will soon enact a law that puts these three countries on the list of countries safe of persecution. Thereafter, minorities like the Rroma will have very poor chances of obtaining asylum in Germany. This is being criticised especially by social democratic politicians and non-governmental organisations. Recently, the Central Council of German Sinti and Rroma has spoken out. Its chairman, Romani Rose, criticised in his statement that the three countries are anything but safe for Rroma: “In the three countries, the argument goes, there is no persecution, torture, violence or degrading treatment. […] Life for Rroma in Serbia, Macedonia and Bosnia-Herzegovina is anything but safe, Rose declared. “Large parts of the minority in these countries have no chance in the labour market, they are excluded from any participation in social life.” For Roma, which are merely tolerated in Germany, the implementation of the plans could mean deportation.” While it is true that the Rroma in the Balkans were exposed to little discrimination until 1989, and many of the common stereotypes about the minority originated in Western Europe, this does not mean that the exaggeration of ethnic differences and the marginalisation of the Rroma have not become a real issue since then that affect many members of the minority. The adoption of the new law is due to an increase of asylum applications from Serbia, Macedonia and Bosnia-Herzegovina, which are turned down in the majority of the cases as being unfounded. However, these decisions are also criticised, since individual fates of exclusion and persecution get too little attention and are not considered appropriately due to lack of evidence. The status of safe countries puts administrative estimates about the protection of the civilian population, especially minorities, over the individual experiences of those affected. Whether this is a smart procedure that meets the real-life experiences of victims of discrimination, should be critically assessed. What matters in the end is the individual fate and not the official status (compare Amtsberg 2014, Attenberger/Filon 2014, Die Welt 2014, Ulbig 2014).  

Eastern Europe correspondent Mappes-Niediek (2014) contradicts this opinion: He claims that the Rroma in South Eastern Europe are often affected by poverty, but are not persecuted. In Macedonia and Serbia, the Rroma rather build part of local communities and are found in all social classes and positions. Even the Rromanes is widely accepted in Macedonia: “Traditionally, in Macedonia and Serbia, it is far less disparagingly spoken about Roma than in the neighbouring countries of Hungary, Bulgaria and Romania. The major, wearing his chain of office and shaking hands, attend Roma celebrations. In the newspapers one respectfully speaks of “citizens of Roma nationality”, and ethnic Macedonians also attend Roma pilgrimages. The European cliché that Roma steal is unknown in both countries. […] If Roma are exposed to persecution somewhere in the region, then it is the EU-country Hungary, where right-wing extremist groups inflame the atmosphere, literally hunt for Roma and the police looks the other way. However, from EU-countries no asylum applications are accepted in principle. Even discrimination based on ethnicity is likely to be far less in Serbia, Macedonia and Bosnia than what Roma have to endure in Hungary, the Czech Republic or France.” Thereby Mappes-Niediek addresses an important point: the difficulty of assessing the discrimination or acceptance of a minority that is already perceived very one-sided in the public in its entirety and complexity. For Mappes-Niediek, the Rroma in South Eastern Europe are particularly affected by poverty. This is certainly true for a part of the minority. But he also hides a part of reality: in particular the integrated Rroma, which can be found in all the countries of Europe and are not perceived as Rroma by the public. Rroma should not be equated with an underclass. They build part of all strata of society. Regarding the aspect of discrimination, the individual fate should still favoured to a reductionist, generalising assessment: because mechanisms of exclusion in a society cannot be read on a measuring instrument. They are subtly distributed in all spheres of a nation and not necessarily occur in the open.    

06.08.2014 Memorial of the Rroma Holocaust

Many international newspapers reportes about the mass murder of Rroma on the occasion of the 70th commemoration of the evacuation of the Gypsy camp in Auschwitz-Birkenau. On August the second, 1944, the remaining 3000 inmates of the camp were killed. The inmates of the Gypsy camp actively resisted and barricaded themselves in the barracks. After the rebellion was put down, approximately 3000 of the 6000 Rroma were classified as capable of working and taken to other labour camps. The remaining 3000 – mostly children, women and old people – were gassed or shot. Previously, tens of thousands had already been deliberately starved to death or died of plagues and epidemics. The interior minister of Baden-Wuerttemberg, Reinhold Gall, pointed out in his speech that the Nazi atrocities would not have been possible without the opportune collaboration of the authorities and the police. It is therefore necessary to critically question this passive tolerance but also active support of fascism: “He pointed to the asylum decree of the ministry of the interior of Württemberg in November the 7th, 1938, which made it possible that children could be classified as “Gypsies” and interned into protectorates. “For too long, the authorities have not concerned themselves with their own history”, he said. Also Thomas Schnabel, director of the museum of contemporary history, pointed out the “fatal cooperation between police, interior ministries and the Gestapo.” For example, the police of Karlsruhe had gathered 150 Sinti and Roma in the courtyard of its bureau to bring them to the collection camp Hohenasperg, from where they were deported to Auschwitz” (Schmidt 2014). The chairman of the central council of German Sinti and Rroma, Romani Rose, emphasised in his speech at Auschwitz, under the presence of survivors and politicians, the worrying rise of right-wing nationalist and extreme right-wing parties and groups: “With great concern we see that right-wing extremist and violent parties and organisations in Europe are increasing and find an echo to their slogans into the mainstream of society” (Baltic Rundschau 2014). Roses indication of the missing lessons of history is of particular importance. Only through an insufficient remembrance of past atrocities against minorities such as the Roma can the renewed rise of racism against marginalized groups be explained. These tendencies are reinforced and fuelled by economic and social issues. At the commemoration, young Rroma from 25 European countries were present. The memory of the atrocities committed by the Nazis should not be forgotten and passed on to the younger generation. In his speech to the German Bundestag on January the 27th, 2011, Zoni Weisz called the genocide of the Rroma justifiably the “forgotten Holocaust”. Repression was rarely the right method to sort out a problem. West Germany only recognized the Rroma genocide in 1982,  at which time, many of the survivors had already died. The Holocaust of the Rroma is repeatedly falsely equated with the word Porrajmos, also in some of the articles cited here. The expression, which emanates from the verb porravav and means “to open widely”, is often used in the context of sexual activity and is therefore not appropriate to describe a genocide. Among the Rroma there is no recognized term to describe the Rroma Holocaust (compare ARD Tagesschau 2014, Deutsche Welle 2014, Gribben 2014, Gulyas 2014, Keating 2014, Kushen 2014, Libération 2014, MDR 2014, MiGAZIN 2014, Roth 2014, Die Welt 2014, Weisz 2014, Wetzel 2014).

23.07.2014 Halle: agitation against Rroma

German newspapers report on agitation against Rroma in Halle. Around 700 people have organised themselves over Facebook and deliberately incite hatred against immigrant Rroma. This happens both in the social network, as well as adds on public sidewalks, walls, and junction boxes, on which xenophobic slogans were attached. In the meantime, the authorities removed them. The prosecution has taken up investigations on suspicion of demagoguery: “But the anger of local residents become more intense and has gone public. On the weekend, doorways were smeared, among others with the slogan “Roma out”, with the S replaced by the runes of the squadron-SS. On a specifically founded Facebook group, expressions like “filthy pack” and “brutes” were posted. OnemMember of this group is also the CDU member of parliament Christoph Bergner – what has let to protest at the political level” (Wiemann 2014). Bergner, in return, tries to appease and dissociates himself from the xenophobic manifestations decidedly. He wants to take the concerns of local residents seriously but dissociates himself from the hostile comments, he stated. The message about problems with immigrant Rroma is symptomatic of a one-sided reporting, which usually portrays Rroma pejoratively. The difficulties with the immigrants seem to be exaggerated. There are also other voices, which don’t report any problems with the new residents. Not all immigrants from Romania and Bulgaria are Rroma, since they represent only a minority there. There are also ethnic Bulgarians and Romanians who migrate to Germany. In addition, a minority should not be equated with an underclass. There are also many Rroma who belong to the middle class. The negative propaganda against Rroma negates all these details. This is dangerous. Romani Rose, chairman of the central council of German Sinti and Rroma, meanwhile calls for stronger involvement of the authorities. The state is too lenient towards inflammatory language, as the last election campaign showed, when racist slogans such as “money for grandma instead for Sinti and Roma” were tolerated upon reference to freedom of expression, Rose states (compare Halle Spektrum 2014, Möbius/Prasse 2014, Wiemann 2014).

16.07.2014 New study: Rroma in German media still heavily discriminated against

Several German newspapers report on the latest publication of political scientist Markus End who studied the stigmatisation of the minority by national media on behalf of the documentation and cultural centre of German Sinti and Roma. The study entitled Antiziganism in the German public. Strategies and mechanisms of media communication takes a critical look at the representation of Rroma by and in public media. End did not only focus on extreme, obvious cases of stigma and racism, but rather on the subtle ways of thinking in racist discourses that constitute the basis for the minority’s rejection. One of the author’s central finding is that journalists who are usually producing a differentiated coverage also use the false and prejudiced presentation ways in the case of this minority because they don’t work critically enough with alleged facts. The racist stereotypes are found among all types of media, in Boulevard as well as in so-called quality media.

In the course of the debate on immigration from Romania and Bulgaria, the tendency prevailed to speak of “poverty immigration”. However, this expression was implicitly assimilated to the meaning “immigration of poor Rroma”. Such coded statements are as problematic as open hostility towards the minority. Romani Rose criticises the same problem concerning the use of terms “poverty”, “crime”, and “Rroma”: “problems, crime, poverty. There are many stereotypes who are associated with the ethnic group. “The stigmatising debate has intensified lately, said Romani Rose, chairman of the Central Council of German Sinti and Roma. The fact that Roma and Sinti are repeatedly mentioned in the same sentence with crimes lead to the fact that the allegations against individuals are made into an identity-feature of all Sinti and Roma, he explained. The same is the case with the allegation of poverty: “Poverty is not an identity-feature of our minority. What does poverty have to do with ancestry?” No group is so heavily marginalised in Germany as Sinti and Roma, Rose states (Ambrosi 2014). Christine Lueder, anti-discrimination commissioner of the federal government, criticised the excessive passive tolerance of discrimination by the German government. It should do more to tackle stigmatisation and marginalisation of this minority. Romani Rose demands from the German government an annual report on discrimination against Rroma in Germany. As the media themselves report about these shortcomings, they – first of all – have the responsibility to do something about it. Therefore, in the future, Rroma should be represented in the broadcasting councils of the public channels. At least, in Germany, in contrast to most other Western European countries, there is a consciousness for the Rroma living in an integrated and invisible fashion, having a German passport:  one estimates them at around 100,000 persons (compare Emmrich 2014, Grunau 2014, MiGAZIN 2014, Neues Deutschland 2014, Rroma Foundation 2014, Scholz 2014, Verein Roma-Service 2014).

16.07.2014 “Memories of Holocaust victims are lost with the graves”

Stoll (2014) and the SWR (2014) report on the expiry of the concessions of graves of Holocaust survivors. The graves of Rroma who survived the Nazi genocide are more than just resting places to the members of the minority. They are also memorials to the victims of National Socialism and thus have an historical value. Approximately 3,500 tombs are affected. Romani Rose calls for conversion of the tombs of Holocaust survivors to honour-graves with eternal resting right. It is significant that the Jewish cemeteries were granted this status a long time ago, whereas the Rroma have been denied this expression of respect until now: “The chairman of the Central Council of German Sinti and Roma, Romani Rose, has urged the federal and state governments on Monday to do more for the tombs of Sinti and Roma. The graves are also places of memory to the victims of the Holocaust, he said in Heidelberg. […] “If the graves are eliminated, then the families also lose the memory to a part of their biography and to the people who have fallen victim to an unique racist crime”, says Romani Rose […]. He goes even further: he states that the sites are also “learning sites” for the population: through them, one conceive what was once possible in Germany and what appears inconceivable today” (SWR 2014). The Rroma Holocaust was only recognized in 1982 by the chancellor Helmut Schmidt. This only happened after massive protests by Rroma in Germany, who did not want to tolerate the continuing discrimination against them in the post-war period any longer. Rose emphasizes that the survivors’ graves are also places of remembrance for the rest of the family members who did not return from the concentration camps. He appeals to the policymakers that one finally recognises the graves as eternal resting places.

04.07.2014 Rroma and stereotypes: prison sentences against Rroma child traffickers

Nicolas (2014) provides information about a trial against fifteen Croatian Rroma by the French prosecutor’s office. The prosecution requested for five of the fifteen defendants the maximum sentence of ten years of imprisonment. The Rroma are accused of deliberately having instigated minors to steal and to having traded them amongst each other. The children were literally educated to steal, the prosecution states. The charge is organised crime, human trafficking and group theft. The accused are charged with the involvement in over a hundred thefts, of which the vast majority was committed in France. The gangs were allegedly built on hierarchical families, that were lead by a clan chief: “For the judiciary, those offenders, who settled on sites in  Lorraine and Alsace, belong to family structures that are completely hierarchiszed, with up to seven clans operated in the mode of groups that are directed by family chiefs from afar. The operation mode was always the same: burglaries during a few days, aimed at homes in a given sector, virtually raids to find jewellery and money” (Nicolas 2014). With this charge, Nicolas conveys a common misconception about Rroma. The accusation of criminal, hierarchically organised family-gangs, who commit crimes on the command of a clan chief, has been transformed into an unquestioned fact. However, this supposed fact is based on massive prejudices, misinformation and culturalising racism. Rroma are not more criminal than other ethnic groups. A cultural explanation for crime is necessarily racist and ignores and discredits the majority of the blameless Rroma, living integrated. The idea of hierarchical family ties traces back to the projection of the medieval caste system onto the Rroma. However, this is incorrect. While it is true that the family has an important place among the Rroma, the organization is largely egalitarian. In addition, the stereotype of arranged marriages is communicated, which is only true for a minority of the Rroma. Furthermore, the phenomenon of child trafficking, as it is presented here, has to be critically questioned. Social science studies show that social realities behind begging or petty crime are largely hidden. Similarly, the structural differences of the societies involved and any related reasons for a migration from Romania to France. The research conveys a more complex, contradictory notion of the subject and points out that crimes such as incitement to begging or trafficking of children are pervaded by a wide variety of morals in the analysis and assessment by authorities, which deny the perspective and motivations of the people concerned and force on them their own ideas of organised begging, child trafficking or criminal networks (compare Oude Breuil 2008, Pernin 2014).
